Our Judiciary Is a B.N Judiciary.

The whole episode displayed by our executive and the Judiciary is sickening to the core.It did not seem possible that the Judiciary would be blatant to disregard the constitution when they made the decision affecting the integrity of the Legislature. But on the 16th april , 2009, they did just that. They lifted the suspension imposed by the Perak Speaker on the Menteri Besar and the six excos. All this despite the fact the article 72 of the Federal Constitution disallowed the Legislature Proceedings to be subjected to any Judicial review. If the apex court can make judicial review on the proceedings of the Legislature then what does the Doctrine of separation means in the context of our Parliamentary democracy? If this is how it works then we might as well appoint federal court Judges to sit in the legislature and review all its proceedings.

It appears quite evident now why an UMNO stalwhat who was also a legal advisor to the party was parachuted to be the head of the apex court. It seems quite convenient that the two branches of govt, the executive and the Judiaicary has worked hand in glove to ensure that the illegitimate Govt of Zambry has a clear path to be installed as the legitimate govt before the May 13th deadline when it is mandatory for it to hold the next Legislative assembly meeting or face dissolution of the assembly.

With unseen hands interfering in the decision of the apex court to ensure that a illegitimate Govt is installed in Perak and thus frustrate a govt elected by the people, the whole sordid episode has brought our Judiciary to public ridicule. Its action has only seves to confirm the suspicions that it is not acting independently as a separate branch of the govt but is acting subserviently to the Executive. It also lends further credence to the suspicion that the Judiciary is a B.N judiciary

The two Murderers of the Mongolian Woman should Not escape Punishment

The blogosphere is innundated with alot of speculations that the two UTK police accused for the murder of the Mongolian model will escape the gallows. From day one of their trial every attempt was made by the police to conceal their identity. Now that the trial is over and the verdict has been given it is about time that their annoymity should no longer be kept in wraps. The public is entitled to catch a glimpse of these two evil persons who committed the dastedly act of taking the helpless, defenceless life of a woman who was the mother of a six year old child.

In evidence given during the initial part of the investigation it was revealed by one of them that the woman pleaded for her life and the unborn child she was carrying. But despite her passionate plea for mercy, the police officer coldly and mercilessly shot the woman not once but twice .In the second part of their premediated cruel act, explosives were planted in various part of the woman's body and blown to smithreens.

Like many Malaysians I have no sympathy for these two men who will face the gallows. They committed a cruel act on a defenceless woman. In short they both deserves to die although the main protagonist remains free and unindicted for the crime.

Because there are speculations that the two men will not face their punishment, the Govt should firstly reveal their identity to the public. Afterall why should they take their annoymity to their graves? Then on the date of their execution , independent observers should be invited to witness their executions. This will dispel any doubts that there is a conspiracy to free the two murderers and giving them another identity to live in freedom.

If the execution is carried out in accordance with the court's verdict, it will serve as a warning to all future police personnels that any murderous act carried out even with the connivance of their superiors will not escape punishment .

Muhyiddin Need to Change His Mindset.

Tan sri Muhyiddin's statement that chinese voters are ungrateful by voting for Pakatan Rakyat clearly shows that the mentality of UMNO leaders have not changed despite the march 8th electoral debacle.By throwing monetary assistance to chinese schools during election times, Muhyiddin naively thinks that the chinese electorates should be grateful and give their votes to B.N.

For the last 50 years that strategy worked because the chinese people trusted their MCA representative who told them that it was the correct thing to do.But MCA betrayed the chinese people .MCA leaders failed to elevate the position of the chinese and were merely contented with their ministerial posts and the honofiric title that went with it.And that certainly explain why MCA can no longer claim to represent the chinese people. With only 15 Parliament seats in mostly malay majority areas as opposed to DAP's 28 Parliament seats in chinese populated areas it would be correct to say that DAP is the voice of the chinese people.

Chinese schools had to survive mainly on public donations and once in a while if there is a bye-election in their area they were given token donations in order to secure chinese votes.Muhyiddin should be aware by now that such political bribery to obtain votes by giving donations during election time is now no longer tenable. The money disbursed are from taxes collected from the tax payers and Mahathir himself acknowledged that 90% of the taxpayers are chinese. So giving back money to chinese schools are not something they should be grateful for.As a matter of fact, such allocations for chinese schools should have been mandatory and given without any strings attached. The chinese are now wiser. They will take whatever that is given but there is no guarantee that they will give their votes in return. There is no trickery on the part of the chinese as claimed by Muhyiddin. They just merely accepted what was given and voted in accordance with their belief as to who deserve their votes.

Muhyiddin would do well to change his mindset that by throwing some crumbs to the chinese electorates they would in return be obliged to vote for him.The chinese people have no interest to be King maker or to have any political power. All they want is to effect some political change so that all Malaysian citizens irrespective of race and religion can have an equal stake in this country of ours.

The Ex-Home Minister was a strong ally of Pakatan Rakyat.

Pakatan Rakyat lost a strong ally when the Home Minister , Syed Hamid Albar was replaced by Najib's cousin, Hishamuddin. With Syed at ther helm of the Home ministry, Pakatan won alot of previously B.N supporters. Many were appalled at the authocratic manner in which the Home Ministry directed the police to curb what was harmless peaceful assembly. Even peaceful candle light vigils were met with brute force from the police who were suppose to be defenders and protectors of lawful citizens.Even small children handing flowers to the P.M were manhandled and taken into custody.

Even innocent reporters who reported on the racists and seditious words uttered by an UMNO member from Penang was not spared and was taken into custody but later because of public outcry the Home Minister offered the lame excuse that she was taken in for her own protection. Even the popular member of Parliament , Theresa Kok was arrested under the ISA purportedly because the ex-menteri Besar Toyo had wrongly reported that she had petitioned against the noise emanating from the mosque in Shah Alam .Because unfettered power was given to one man who suddenly inherited so much power that it was frivously applied without any regard to the truth or falsity of the accusation. Hence when it was later found to his chagrin that he had acted impulsely on both counts the Home Minister had to eat humble pie and released the two innocent victims. His other ridiculous forays of arresting and blasting tear gas to disperse peaceful assembly was so brutal that even B.N supporters turned against the govt.

The ex-Home Minister last contribution to Pakatan Rakyat's cause was during the tri-election when police issued warnings that the name Altantuya and the Perak sultan's decision not to dissolve the state Assembly should not be mentioned during the ceramahs.Obviously, the Home Minister was taking 'ampuism' to a new height by making sure that the incoming P.M''s name was not associated with the Mongolian model Altantuya. It really boggles the intelligent mind how a Minister could dictate such frivolous conditions and prohibited the utterance of the name a woman who was brutally murdered. To compound matters , opposition parties were not issued with permits to hold ceramahs and were constantly harrassed and force to disperse. All these measures by the Home Minister purportedly to help the B.N govt back-fired and support for the opposition increased many fold.

Pakatan Rakyat's success in both the bye-elections in Bukit Selambu and Bukit Gantang owe largely to the stupendous policies and actions of the Home Minister. With the removal of Syed Hamid Albar as Minister of the Home Ministry, Pakatan Rakyat lost one of its strongest ally. It remains to be seen whether the new Minister, Hishamuddin, the cousin of Najib would be an ally or foe of Pakatan Rakyat.

B.N is Beyond Redemption

The message from the two bye-elections, Bukit Selambu and Bukit Gantang is very clear. The people want a change and they now view B.N as beyond redemption.B.N's last cast of the die by bringing on the expired date Dr. Mahathir was of little help. The last thing the people wanted was more of the Mahathirism we had already endured for the last 22 years.Obviously the strategy back fired and Nizar, the former ousted M.B won with a handsome and improved majority.

The new P.M's touted reform of releasing the 13 ISA detainees , his well publicised walk about in the city before the election to win over chinese, indians and malay support apparently did not swing any last minute votes in the two constituencies. In the end it was just a walking exercise for him to meet the people in the city.Nothing more. The people repaid the courtesy of his visit by smiling and waving to him.

The result of the two bye-elections, especially the Bukit Gantang election clearly provided an indication to the P.M that they were not happy with his illegal takeover of the popular Govt under Pakatan Rakyat. And if he is listening he should now allow the dissolution of the Perak assembly and call for a fresh election to allow for a new mandate to be determined by the people of Perak. His failure to do this would cause irreparable harm to his current administration and adversely affect his reputation as the new P.M.

The current long protracted impasse in the Perak govt should not be allowed to continue now that the people have spoken through the ballot box that they want fresh elections for the state.Admittedly, a mistake was made in the initial takeover of the state but a bigger mistake would be to allow the current situation to deteriorate further without a final solution. It takes a good statesman to realise one's mistake and rectify it with the correct decision. After all the new P.M still have 4 more years to win back the people of Perak should the people decide to retain the Pakatan Rakyat Govt in the fresh election.

Why is MACC so slow to act on Khir Toyo's Disneyland escapade with his Family and maid?

After looking into PNSB's dealings , Selcat have revealed khir toyo's abuse of his position by using funds from Statutory Bodies to pay for his family trip to disneyland. He and his wife were given every opportunity to defend and rebut all those allegations adduced during the course of the Selcat hearing but both of them chose not to attend the hearing. The CEO of the GLC could not have contrived or manufactured the evidence which confirmed the trip was paid for his wife, children and maid.

These are serious allegations of a public servant using public funds for his personal expenditure. The payments made were all supported and documented by the Statutory Bodies accounts. The witnesses including the CEO have testified that the whole trip for Khir Toyo's family including the children and maid was paid by PNSB. The evidence adduced during Selcat's hearing should have been sufficient to indict Khir Toyo on several charges of corruption. Now the question remains to be answered is why is MACC adopting the 'elegant ' silence approach when it was quick to reproach M.B Khalid for donating a few cows to his constituency using PNSB's money?

Are we to believe that MACC is adopting a selective prosecution approach in discharging their duties? It appears quite evident that Opposition politicians are being selectively hounded by MACC whilst B.N's politicians corrupt practices are been ignored. As a concern public citizen I would demand the MACC Chief to account for his reason why they have not been impartial in carrying out their sacred duty of investigating and prosecuting all politicians irrespective of their political divide. If they are impartial as they claim to be then we demand an immediate investigation and prosecution of Khir Toyo's corrupt practices. Public servants who dipped their hands in govt coffers must be brought to book and we shall not accept any lesser punishment for the former menteri Besar, Khir Toyo.Any punishment meted and that includes custodial sentence imposed should served as a deterrent to all those public servants who have abused their position by dipping their grubby hands in govt funds to finance their family and personal lifestyle using taxpayers money.

MCA, MIC and Gerakan Should all be Banished to the Dustbin of History.

While the unsavoury events unfolded with the take-over of the legitimate Govt of Perak by B.N, where were the voice of MCA, MIC, Gerakan and the rest of the B.N component parties?Credit must be given to these non malay component parties for maintaining an 'elegant silence'. To remain silent and supportive of B.N's illegitimate takeover of a state that had elected an opposition govt, the parties of MCA, MIC and Gerakan have once again demonstrated that they can no longer claim to represent the legitimate interest of the people it is suppose to represent. They have not only helped to thwart the democratic will of the Perak electorates by being part of the B.N party that wrested the legitimate govt but they have shown that their loyalty is not with the people it purports to defend and protect but instead their allegiance is towards the UMNO leaders .

This episode should serves as a reminder that MCA, MIC and Gerakan leaders have a vested interest in protecting and prolonging the rule of UMNO.Their interest is not to look after nor protect the interest of the members they have sworn to protect. The leaders of MCA, MIC and Gerakan are in there for money power and positions. They are not there to render service probono. In short they are there to enrich themselves .Look at all the MCA and MIC ministers who have retired. They all retire not only with Tan sri and Tuns, but also living a life far beyond their expected means.

Malaysians of all race should no longer be fooled by these so called leaders who enter politics as a means of enriching themselves. For once in our life we must exert our right to rid these parasites who have been plundering the nation's coffers.Let us all Malaysians of all denominations act in unison to banaish these leaders from UMNO, MCA, MIC, Gerakan and all those in the B.N umbrella to the dustbin of history. We cannot afford not to act because if we allow them to continue to rape our nation's wealth then there would not be anything left for our future generation.Failure to rid these parasites is no longer an option, it is imperative that we act now.

Indians will have to live with Samy.

The indian community who elected Samy Vellu to be the MIC President for the 11th term are a pathethic lot.It only serves to confirm the indians are like a flock of sheep who just dont know how to dump a leader who can no longer lead them out of their misery.

With the election of Samy Vellu as the MIC President for another term, majority of the indians who support him should not complain if they are further marginalised . They have made their choice and they will have to live with it for the next three years. If the indians cannot even help themselves by electing a leader who can look after their interest then dont expect others to help them.

After the last General Election in March where the MIC suffered one of the most humiliating debacles where even its President Samy Vellu lost his seat in sg. siput, one would have expected the long serving MIC President be booted out. But the MIC members seemed to rejoice in retaining their leader.

And if the Indians are unhappy with Pakatan selection of Manikumar as their candidate then they should just vote the MIC candidate Ganesan and let the B.N win the seat. The indians in Bukit Selambu should not resort to threats and blackmail that they will not support the PKR candidate because it was not their choice. If they really feel that MIC have done a better job of looking after their interest then they should just support the MIC candidate.

Those Indians who have vested interest in selecting their own candidates in Bukit selambu should just leave PKR. If they cannot abide by the decision of the Pakatan leaders then please leave the party. PKR cannot afford to have members exerting their threats merely because their vested candidates were not selected..Their attitude merely vindicate the suspicions that they are only after the Exco position and not to serve the constituents.Such candidates if elected would not hesitate to party hop if given monetary rewards.

If indeed the indians have made their choice of supporting MIC then PKR should no longer make any concession to selecting any more indian candidates for any seats that PKR are contesting. So far PKR have made alot of concession for the indians in PKR and it appear they are not being appreciated. we continue to hear threats from them and perhaps its time the PKR leader should evaluate their loyalty to the party.

Mahathir Is A Mamak

I was extremely shocked to read the article 'my father would have been proud' related by Mahathir in the nst, dated 21 march . In the article,Mahathir said his father was Mohamad Iskander and that he said ' my father was one of the few malays who ran away to school to get an education'.

Is our former P.M suffering from demntia to even forget his father's actual name? His father was a indian man from the southern Indian state of Kerala by the name of Mohamad a/l Kutty. Therefore genetically Mahathir whose father is indian and mother a malay would be classified as an indian. However our federal constitution says that any man who profess the religion of Islam, practices the custom and speaks Malay would be considered a malay. Therefore under the constitution definition he was a malay but in reality and factually he is an indian Man. But what surprise me and many Malaysians is why is he ashame of his own indian heritage so much so that he even declare that his father was a malay when that is not true.

In his speech at the PERKASA gathering he even lambasted the non malays for equating NEP policy to apartheid. In many of his speeches he has dwelled at lengths the rights and priveleges of the malays and pretending that he also belongs to the Bumiputras and therefore should perpetually be allowed to enjoy the priveleges and rights .

Mahathir is what we called a mamak in Malaysia. Many of them are really Indians who have converted to take advantage of the Bumiputras status. They are what we call fake malays or celup malays. When Penang was lost to the opposition a group led by a mamak stage a demonstration in protest. When Karpal was accosted by a group of UMNO youth members who wanted him to apologise for wanting to sue the Sultan of Perak the unruly group was led by a mamak. These Mamaks are really hypocrites pretending to be more malays than the original malays . Many of the Mamak have taken full advantage of their celup status and have become UMNO ministers. .

Unlike the Mamaks, the original Malays are refine and cultured . I have lived with them in Kelantan for 40 years and they are a civilised lot. They dont go round blaming the non -malays for their problems like the Mamaks opportunist. Two fine gentleman I like to mention is Zaid Ibrahim and Mustapha Mohamad and there are many of them too many to mention.

If Mahathir and his kind continue to call non-malays 'pendatangs' then he should examine his own heritage where his own father came from Kerala.Yes, he should not be ashamed to acknowledge his own Indian heritage and proclaim proudly that he is also a 'pendatng'.

Instead of spending his twilight years in graceful retirement this old man deems fit to foment hatred and ill will among the races. He should realise by now that he no longers holds any power and influence in the party that he once leads. That was evident when he could not even muster enough votes in the Division he once led to be chosen as a delegate in the last UMNO General assembly.

Ali Rustom, the Racist, Deserves to be charged for corruption

Mohd Ali rustam began his career in politics 18 years ago when he was a mere clerk with TNB. From a mere meter reader to his majestic rise to be the chief minister of Malacca, this UMNO politician should have been contented with his swift meteoric rise to the top echelon of UMNO leadership. Not satisfied with being the Chief Minister of this Malacca state, he contested in the last UMNO election and was surprisingly rewarded with the Vice- president Post with the most number of votes.

But the racist side of his character only surfaced when he was invited to be the guest of honour for the People's Progressive Party state convention. With unabashed pride he told his shocked audience that PPP and their members could leave the BN anytime.Yes he didn't mince his words. UMNO according to him had ruled for 50 years and they could continue to do so without any help from MCA, MIC, Gerakan and all the component parties from Sabah and Sarawak.Yes all those component parties could vanish and UMNO will still continue to rule the country. Such was the arrogance of this man.

Ordinary Malaysians can easily visualise what this man would say if he was elected to the pinnacle office of DPM and subsequently as a formality become the P.M of Malaysia. The words that would flow from his racist lips would be non-malays dont have to vote for B.N because UMNO can rule the country without any of your help.

Fortunately for Malaysians, providence might have played a significant part in depriving this racist man a pivitol role in the politics of this nation. With such a man at the helm of any nation, it would most likely the country would descend into chaos and anarchy.

MACC Chief should be Independent and impartial

MACC chief Commissioner Datuk Seri Ahmad Said Hamdam is either not familiar with his work in the agency or he must be acting hastily under the behest of someone in the corridors of power. There is absolutely no legal justification for him to investigate the Perak State assembly speaker decision to suspend seven Barisan Assemblymen last month.

His statement that ' there are elements of misuse of power ' by the speaker does not render him any authority to question the speaker's decision.Article 72 of the Fedral constitution prohibits any court of law to question the decision of the speaker in the federal and state legislature. In other words, whatever decision arrived at by the speakers in the Federal and State legislature is final and not subjected to any judicial review. If the MACC chief cannot even grasp and understand the basic fundamental provisions of the constitution which disllows him from questioning the speaker on his decision to suspend Zambry and his band of Excos then he should not be appointed as the MACC chief. It becomes questionable whether a man of his calibre should even be appointed as an MACC chief.

Now that the speaker in the Federal Parliament have also suspended the DAP M.P for Puchong, Gobind Deo for a year for saying that the DPM is involved in the murder of the Mongolian Model, why have the MACC chief not come forward to say that there was also element of abuse of power by the Parliament Speaker? Is the MACC chief implying that it is alright for the B.N speaker to suspend the opposition member but its not alright for the opposition speaker to suspend a B.N member? The MACC Chief cannot appear to be impartial if its action is only directed at the opposition speaker. It would perhaps be appropriate for the MACC chief to seek the advice of the Attorney-general dept before making a fool of himself. In fact the MACC chief's comments regarding the culpability of the Selangor M.B's purchase of 46 cows and the use of his Lexus car have already cast a serious aspersion on his impartiality. Therefore how can any one expect the MACC to investigate without fear or favour when its Chief have more than one occassion displayed its impartiality in favour of the B.N govt ?

Are Our Monarchs Immune from criticisms?

Why would honest abiding citizens suddenly revert to insulting a monarch who was once upon a time being revered as a model for the royal institution.?Instead of charging ordinary citizens for venting their anger at the sultans, which in their minds and perception had erred in his decision not to dissolve the State assembly, the Govt in particular should look into the cause for the sudden act of impropriety against the royal monarchs. Perhaps it would also be appropriate for the sultan in the light of this event to examine his role as to why his decision had elicited such a response from his erthswhile loyal subjects.

To charge and punish citizens for venting their anger at the source of the ire is merely to suppress their right to express their frustration and anger.Whereas in Thailand there is such a law as leste Majesty, can we also assume that there are also such laws preventing Malaysians from insulting our royalty? Is insulting the royalty tantamount to being seditious?

As citizens of the country are we to remain mute even though a wrong has been committed by the Sultan? Is there no avenue that citizens can ventilate their opinions and anger knowing fully well that the sultan had not acted in conformity with the express will of the people?

History is replete with examples how ordinary people have risen to dispose of their royalty who have acted contrary to the interest of its citizens.Queen Marie Antoinetee was guillotined during the French revolution, the Last czar of Russia and his family was executed and in more recent times, the shah of Iran had to go in exile to America when his regime was deposed by Ayatollah khomeini.Surely our royalty should acquaint themselves with these examples so that they will be wiser in their reign.

Why Did the sultan deliver Perak to the B.N?

Amidst the furore that is consuming the Perak political landscape,Perakians must be wondering at the deafening silence from the Royal household. Since bestowing the Perak govt to the B.N members, Sultan Azlan Shah, the Sultan of Perak has not come out to comment or defend his unpopular decision of not allowing M.B Nizar's request for the dissolution of the State assembly.Even Karpal Singh's appeal to the monarch to come out and say that royalty do not have immunity from being sued in their official capacity did not elicit any response.

The monarch's previous role as Lord president of the Judiaciary would have no problem in convincing the legal fraternity of his decision if indeed there was legal grounds for him to justify his act.Why then did he remain silent even until now?The regal monarch should have been aware of of the sweeping undercurrent of discontent with the B.N machinations which is riddle with corruption and which ended in the onminous defeat in the march 8th general election.

Surely an intelligent and well read man like the sultan would have read the political wind of discontent in Perak which led to the Pakatan Rakyat taking over the state. Then why in one careless moment did he took the unpopular course when he could have done the right thing for his Perak subjects who were crying for their voice to be heard?

There have been numerous speculations as to why he did what he did. Many of them have been unflattering and have only cast aspersion on his impeccable reputation which he had built during his impressive tenure as the Lord president of the Judiciary.

But the question remains and for history to find out why a man who had built a formidable reputation as a righteous man of Law would in one foolish moment sacrifice all his hard earned credentials to a tottering regime which will fall anyway.

Beware Pakatan of 'thy enemies in the Blanket'

Events of the past week and month have revealed one undeniable fact. The whole present government apparatus from the police, judiciary, attorney-general’s chambers and the civil service to the whole gamut of all BN government-appointed bodies are all infiltrated with their supporters and cronies.

Although Pakatan Rakyat may have taken over the five states, many of BN appointed people are still comfortably embedded in the government machineries. Many of them are lying low and waiting for just the right opportune moment to betray their newly-elected masters.

When Perak fell on Feb 5 as a result of the betrayal of the three Pakataan assembly persons, we saw the state secretary arrogantly chasing out the previously elected government from the state secretariat building when they were holding a press conference.

His rudeness and lack of respect for the deposed menteri besar was something we would least expect from a civil servant. But it typifies the behaviour of all those civil servants who were appointed by the previous BN government

.Further, when Pakatan Rakyat speaker of the Perak state assembly V Sivakumar called for an emergency state assembly meeting, the state legal advisor, Ahmad Kamal Mohd Shahid, immediately directed the house secretary not to send out notices for the emergency sitting.

This was obviously an attempt to block state representatives from being notified of the emergency sitting of the state assembly tomorrow. DAP Perak chairperson, Ngeh Koo Ham was correct to comment that, 'The legal advisor has no business to intervene in the process of the house' and that he has no authority to stop the notices being sent out.

In tandem with the legal adviser, the house secretary, Abdullah Antong Sabri, said that the calling of the emergency sitting was ‘illegal ‘because it did not obtain the consent of the sultan.

What transpires from these events remain very clear. The state secretary, the legal advisor and the house secretary are all Umno appointees and they will do all in their power to frustrate Pakatan’s recourse to seek a return of the Perak government.

And from this lesson learnt, Pakatan Rakyat in the remaining four states must cleanse their governments of all Umno appointees in the civil service and from all bodies associated with the previous regime.

It must be clear by now that the Umno appointees serving in the respective Pakatan state govermnents are waiting for an opportune time to betray their new masters. If the Pakatan state governments continue to place their trust in these Umno appointees, they will be doing it at their own peril.

Who was the Pathologist who had certified that Kugan had died of Fluid in his Lungs.

Now that the second post-mortem conducted by a pathologist from the Universiti Malaya Medical centre has shown that the victim died after being repeatedly beaten , surely the family and the public deseve to know why the initial post-mortem revealed that he had died due to fluid in his lungs.

The pathologist who conducted the initial post-mortem must be called to explain why his examiniation did not uncovered what was obviously a case of a man being held in custody and beaten to death.Certainly we would also like to know how he arrived at the conclusion that the man had died as a result of fluid in the lungs and not mentioning in his report that the man was repeatedly beaten to death .

Was the pathologist acting in concert with the police to conceal evidence of a felony being committed? If so then the pathologist can be charged with being an accessory to the commisiion of a murder. Further investigation should be conducted to see if there were any previous incidents of such cases where the same pathologist had given a misleading account of a post-mortem report. If he had done one misleading report it is most likely that he could be involved in a series of other fallacious reports on deaths in custody cases.

If at all he is found to have tampered evidence in order to help the police avoid any criminal prosecution for the custodial deaths, then he should be charged for abetment and accessory to murder.

What remains a mystery is why is there no attempt by the relevant authorities to seek an explanation from the first pathologist to explain his derecliction of duty which totally gave a misleading account as to the cause of death of Kugan.

Emergency Sitting a Threat to Zambry and company.

The Emergency sitting of the State assembly on the 3rd of march should not be viewed as a threat to national security but it is more likely a threat to M.B Zambry and his band of illegal Exco members. Zambry should realised that his position as M.B was as a result of the betrayal of three Pakatan rakyat state assemblymen and not based on the legitimate democratic will of the people. If ever there is a threat to National Security then Zambry's illegal takeover of the Perak state govt could be viewed as a serious threat to the peace and stabilty of the silver state.

Zambry has been going round to tell Perakians that he is the legitimate M.B of the state. If that is so then he should have no fear to call for a snap election so that his position can be legitimately determine by the democratic will of the Perak people. His reluctance to let his fate be determined by democratic election by calling for a snap election only serves to confirm the widespread belief that he is an illegitimate M.B installed through dubious means.

According to the Doctrine of separation of powers, the executive, the judiciary and the legislature are three separate independent branches of Govt.,each having its role in their own domain. Therefore it stands to reason that the Speaker in the Legislature has wide ranging powers to interpret the rules and standing orders as he deemed fit and his decision on such matters cannot be questioned in any court of law which has no jurisdiction to trespass in the Legislature proceedings.

It is totally shocking that the House secretary whose duty is to take orders from the Speaker deemed it fit to attempt to interpret the instructions of the speaker and concluded that the speaker had no authority to call for the emergency sitting. So under what authority is the House speaker acting and under whose instructions was he taking orders from when rightly and legally he should be taking instructions from his immediate boss who was the speaker.

Zambry and his illegal band of UMNO exco members should not pretend that they are the legitimate govt of the state and using the royal Institution to support their unpopular cause.Their hypocritical stance of respecting and protecting the royal institution when their true aim was to use the royal influence to perpetuate their agenda of ruling the state by illegitimate means.

UMNO Youth Police Report is Legal whereas Indian Police report is illegal

Can the Home Minister explain why 100 police reports made by UMNO Youth against KarpalSingh did not meet with any chemical laced water cannon whereas a handful of Indian reports were brutally met with baton carrying police and a chemical laced water cannon?

The Home Minister has once again shown it is incapable of meting justice equally to all Malaysians.UMNO youth and its members seemed to be given preferential treatment in whatever they do and there appears to be one separate set of law for them.

We have seen UMNO youth members holding demonstration without any permits, barging into the August Parliament to manhandle Parliamentarians and uttering seditious words with impunity. While others would be immediately punished for any such infringement of the law, we see police and authorities indifference to UMNO members breached of any laws.

Pakatan Rakyat will continue to benefit from the Home minister partial treatment of Malaysians. As long as Home Minister , Syed Hamid Albar is at the helm of this ministry Pakatan Rakyat will have an ally who will ensure the reign of Najib will be a short and undistinguish one.

Najib: You Lie , You Pay

Najib should be the last person to offer the threat that any one making a false report would be prosecuted. Can he tell us why till today,Bala the private Investigator who made two contradictory Statutory Declarations implicating him has never been brought to account for his purportedly false declarations? Is Najib implying that as long as the false report does not concern him then one could be prosecuted.

The Malaysian public deserves to know why no action was taken against Bala, the P.I who made the two Statutory Declarations implicating Najib? And perhaps he should also ask the police to investigate why Bala was not questioned as to the authencity of the two S.Ds. Surely in this case a false declaration has been made since two declarations were made and only one of them can only be the truth.

What is even more astonishing is that the S.Ds implicated the DPM, Najib.Any innocent person implicated in the S.D would be furious and would take stringent measures to clear his name. But instead there is a deafening silence from Najib who seems to treat the unfolding drama with disinterest. His action of swearing on the Koran that he was innocent only seem to convince the public that there is more to it than he would care to admit.

What even makes the whole unsavoury episode more interesting is the nonchalant manner in which the police is treating the disappearance of Bala, the private Investigator. No one seems to care and no one seems interested in finding out the truth as to the truth or falsity of either of his statutory Declarations.

Pakatan Rakyat should Field a malay candidate for Bkt. Selambau.

Pakatan Rakyat's leader should not follow B.N's selection of an Indian candidate for the Bukit Selambau state seat.Pakatan Rakyat will easily win this seat if it chooses a malay candidate by virtue of the 51% malay majority area.

B.N is likely to field an indian candidate from MIC and PKR should select a malay candidate to contest against him.As long as the malay candidate can look after the interest of all the races in the constitutuency I see no reason why we should follow B.N's quota of indian candidates to contest in certain areas. The political reality of the constituency dictate that a malay candidate stands a good chance of winning the seat and I am sure the majority of the chinese and Indian voters will support the PKR malay candidate.

PKR must moved away from B.N's race based ideology. It must demonstrate to Malaysians that a malay candidate from PKR can and without any problems look after the interest of chinese and indian welfare. This will be a refreshing departure from B.N's race based politics in particular and UMNO's race based allocation of seats to its miniority partners , MIC. in general.

If PKR is looking forward to that change then there is no other option but to have a malay candidate for the Bukit Selambau state seat.

MACC is Acting On Behalf of the B.N Govt.

When the B.N govt spend millions to send a spaceman to space using taxpayers money why was there no outcry that it was corruption? Now that the Pakatan Rakyat Govt is spending a fraction of the money to buy 46 cows that were slaughtered and distributed in his constituency during the Eid-Al-Adha muslim festival december the MACC has deemed the act as corruption.

MACC should first investigate those responsible for using taxpayers money to send a man to space before even to investigate why money was spent to buy 46 cows for the muslim religious festival.MACC 's action can only be construed as acting on behalf of the govt to cast aspersion on the Pakatan Rakyat's Menteri Besar. What was even more shocking was for the MACC leader's statement on the Selangor MB. Why did he not give a statement when the IGP and the A.G was being investigated?

The perception by the rakyat is that the MACC at the behest of the govt is merely targetting Pakatan Rakyat's politician. In Ipoh, the two state assemblyman who subsequently hopped to B.N was also investigated for corruption. Is it a mere coincident that the B.N politicians are not being investigated for any corrupt act while it seems the Pakatan Rakyat's are the only ones indulging in corrupt acts.?As suggested in the article in Malaysiakini, the MACC chief should perhaps join a political party so that it can further vocalised its support for the B.N govt.

Sultan Has Ruined His Impeccable reputation.

For someone whose past tenure as Lord President was outstanding, the decision of Sultan Azlan Shah of Perak to allow B.N to be installed as the govt of Perak would return to haunt him.His past credentials was impeccable and his son , the Raja Muda and his own frequent speeches was always about being neutral and bipartisan in their decision less as warned by them it will spell the doom of the monarchy. How prophetic it would become because after a few days of this speech it seems the royal monarch had failed to heed the very words it had espoused.

The backlash of anger by the Sultan's decision was obvious. Overnite the sultan was the subject of disdain and ridicule. Even his web site was deactivated because of the avalanche of criticsms and ridicule that had smeared his once revered blog. Not many people expected the once loved ruler to bow to the demands of the UMNO leaders when it was quite obvious that the rakyat wanted a snap election to give a new mandate to a legitimate govt.

The act of refusal to grant the M.B Nijar to dissolve the state assembly and call for fresh election was a betrayal of the people's trust that the ruler would protect. Instead, the ruler bowed to the wishes of the corrupt regime to usurp a rightful Govt elected by the people. The words that a ruler misdeed would cause the downfall of the monarchy has certainly being so prophetic.

Maybe there is still some modicum of hope that the sultan could salvage some of his previous pristine reputation if he could now dissolve the state assembly and call for a fresh state election to determine the mandate of the Perakians.

The Corrupt politicians.

Can anyone believe when DPM Najib said that no money was involved? If that is true then the three who hopped over to B.N must be so impressed with UMNO's leadership to abandon Pakatan Rakyat. Clearly there was some incentive to lure the three assemblyman and woman to the B.N's fold. History has always shown us that politicians has a tendency to compromise on principles they professed when offered reward of power and money.

When you elect postman, clerks and retired penshioners to be their wakil Rakyat that is what you will likely end up with.Being offered $15million to change one's allegiance is alot of money and admittedly, not many can resist such a lucrative offer. Many opportunists are in politics not because they want to serve the people but because of what it can offer in terms of money and power. The moment they are not offered lucrative positions they start showing their true colours and the first opportunity they get they will abandon their principles and party's allegiance.

It was no coincidence that the two state assemblyman targeted to change their allegiance were going to face a corruption trial on 10th February. So it does not take a genius to reason why the two was easily persuaded to hop over to B.N.

However , the will of the people must be respected and cannot be thawarted merely because there were politicians who betrayed the trust of the people.

The only resolution to this dilemma is for the Perak sultan to dissolved the state assembly and order fresh election to determine the people's mandate to govern the state. Taking over the govt through the backdoor using dubious means is unacceptable and will not contribute to good governance.Let us hope and pray the sultan will do the right thing.

B.N's Power grab has Frustrate the will of the people.

Its sickening.Once again the will of the people has been frustrated by the B.N govt which has used their power and money to lure the numbers to take over the Perak Govt.

It does not take a genius to know where the Pakatan Rakyat weakness was centred. The Behrang Assemblyman,Jamaluddin Mohd Radzi and the Changkat Jering assemblyman, Mohd Osman Mohd Jailu were involved in a corruption case which was scheduled for hearing on the 10th of february.

What was offered to them is a matter of conjecture but their disappearance during the first few days of the Chinese new Year holidays indicated some kind of deal was struck and the two PKR member was going to hop over to B.N in order to save their skin in the corruption case. With the deal now struck, it would be interesting to see how the corruption case will proceed. Most likely the powers behind the B.N govt will arrange some kind of trial which will eventually exonerate them of any guilt.

The only way for Perak to have a govt of the people and for the people is to have a snap election which will finally decide which party should have the mandate to form the govt. This can only happen if the Perak Sultan play a pivotal role by being non partisan in his decision to call for a snap election.

For a democracy to survive and flourish the sultan must pay heed to the wishes of its people. The march 8th Election of 2008 which swept Pakatan Rakyat to power was no accident. It was the wish of the people who were bent on seeing a change and if B.N was allowed to frustrate the will of the people then that change will not happen because the powers behind the govt which used their influence of power and money have deemed it fit to cast aside the aspiration of the people. This is a testing time for our democracy and the Perak sultan's decision will no doubt indicate which direction our fledgeling democracy will be heading.

B.N Cannot Change

I refer to the article 'change or be voted out' where the DPM pleaded with his component party to change or be voted out.

The sad part about his statement is that it is not B.N that needs to change but tragically it is UMNO which helms the B.N and the govt that needs to change. For the DPM to say that B.N needs to change reflects his ignorance why B.N had suffered two consecutive defeats in the last two By-election.For the last 50 years UMNO has been the mainstay of first the Alliance Party and the now Barisan National Party.Other component race based parties like MCA,MIC , Gerakan and a host of other mosquito parties are merely passengers in the B.N party. They exercise very little influence in the direction and policy of the govt which principally is constituted by UMNO's dominance.

Mahathir left a legacy of political patronage which till today is strongly embedded in the UMNO members psche. This political patronage have now seeped into the party't election where party's position can be bought by the highest bidder. This practice have been so prevalent and widely accepted but done with utmost secrecy that it is unlikely it can be stopped by the top party leader. Most of the top UMNO echelon leaders are too comfortable with the old practice of accumulating wealth and political patronage that it is highly unlikely that they will be prepared to abandon it.

Therefore the writing is already on the wall. The demise of B.N constituting UMNO, MCA, MIC and all the other component parties is inevitable. With the arrogant and mindless Home Minister, Syed Hamid Albar at the helm of the Home minister, the opposition has a strong ally. His boorish behaviour and authoritarian attitude has virtually alienated the population against the govt. With such Ministers at the helm of the current administration the opposition merely have to just sit back and see B.N self destruct.

The DPM's brazen and corrupt practice of doling out contracts to UMNO cronies during the Trengganu By-election was not only revolting but a sad statement that he himself was not even aware that such buying of votes was no longer acceptable in our society. So how could the B.N party in general and UMNO in particular reform when its leader who was suppose to take over from Abdullah Badawi does not even know what the people expect of its leaders.?

The only beacon of hope that Malaysians have is the death of UMNO, MCA , MIC , Gerakan and all the other small component parties that constitute the Barisan National Party. They have been too long entrenched in the Malaysian political landscape and for a change to take place, we need to sever the old appendages that have festered and corrupt our malaysian system. We need to bring in fresh blood without the old baggages and try to reform the machinery that has been corrupted by the ersthwhile B.N leaders. We need to start a new page in our country's history and transform our multi racial society to one that is united to face the globalised world of today.

PKR should Just Sack Manikavasagam.

I wish to refer to your article 'Will Mike make good on his threat'.

The member of Parliament of Kapar should not only quit his PKR post but should also relinquish his Parliament seat. His antics and threats to the PKR party is a disgrace and such behaviour should not even be tolerated by the party hierachy. For one man to hold the party to ransom is a sad reflection of poor management of the party. If he does not quit the party then he should be sacked. We dont need M.Ps who constantly issue threats in order to get their way. This member of parliament must be taught a lesson that he did not win the election on the basis of his personality. He won the seat because people wanted a change . If PKR had put a dog or a pig in his place they would also would have won with a handsome majority. Manikavasagam should not be imbued with his own pride that he won the seat on his own ability.

Its about time that Manikavasagam and many of his indian colleagues who have been too concern about their self importance should re-examine their contribution in the march 8th election. In all the seats that they contested they could not have won a single seat without the support of the chinese and malay voters. The indians votes alone could not have elected them as member of parliament. That reality should be evident to the most optimistic candidate and it would do alot of justice if Manikavasagam realises this equation. It was not the indian voters that put him there and if he was to be arrogant in saying that they will form an independent party for the indian PKR M.Ps then it is likely that all of them will only serve one term as Parliamentarians.

For 50 years, the MIC represented the Indian community and all they have to show was a Minister and a few Parliamentary Secretary in the govt to represent them. When the opposition won in Penang and Perak, a Deputy Chief Minister Post was given to an Indian and in the Perak Legislature the Speaker Post was similarly allocated to an Indian. All this was accomplished in a space of few weeks after the election which put the opposition in power in the two States.Manikavasagam should realise that this are giants strides accomplished for the indian community and if he is still bent on biting the hands that feed him I suggest he should leave the position he was elected and let there be a by-election for the people to decide who should represent them.

This time if Manikavasagam does not resign from the party then the leadership should just sack him. The party would be better off without him in the long run. After his latest episode I doubt the voters in his constituency would ever elect him again. There will not be any solidarity in the Pakataan Rakyat if such maverick politicians are constantly allowed to threaten the party leadership.

Perak Mufti does nto Deserve the Tokoh Maal Hijrah Award.

How extraordinary that someone with a blemish record of inciting a riot against a christian church could be rewarded with a Tokoh Maal Hijrah award. This Perak Mufti also made an unsubstantiated statement that there were 100,000 apostates in the country. Where he obtained this figure is only left to conjecture. Therefore one would question those who are responsible for awarding the Tokoh why was this controversial character given such a distingush title when he hardly deserve it in the first place. In fact his appointment has only make a mockery of the occassion.

A person more worthy of the accolade should have been the Perlis Mufti whose many statements regarding religious matters have been an enlightenment. So can the authorities responsible for bestowing the title please justify how a least deserved person could have won the title of the Tokoh Maal Hijrah award?

Penang To keep Bumiputra Quota

Now that Penang has decided to follow Kedah in retaining the bumiputra quota in housing, we are beginning to see the retention of the old B.N practice of perpetuating the race based policy in Housing.Selangor too has remained mute regarding the abolishment of the Housing policy based on race.Prior to the march 8th election it was advocating a policy that if they win they would introduce a housing policy which was based on poverty and need and not on race where rich bumiputras were able to enjoy subsidise houses when poor indians and chinese had to pay the full price. This practice tantamount to poor non malays subsidising rich Bumis in the purchase of houses.

What perhaps anger me and most fair minded malaysians is why is it so difficult to abolish a perverted policy and substitute one that is fair.?And why is the Pakatan Rakyat governed states finding it so difficult to change B.N's race based policy when it was clearly evident that it was discriminatory and racist in nature.?Is not the result of the march 8th election an indication of the people's fervent desire for a change? Then why is Pakatan Rakyat states dancing to the same tune of the B.N old policies?

If DAP, PKR and PAS cannot fulfil what it has promised in its manifesto then maybe all those who voted for them believing there would be a change would have to reconsider their support in the next election. The people voted for a change and if the Pakatan Rakyat governed states cannot provide the impetus for that change then its time we look elsewhere for another party that can initiate that change. If need be maybe we should even revert back to B.N's rule and hope that they have learn their lesson in the last election.

Najib:Razak Baginda is not involved.

The whole picture in the Altantuya saga would be more complete if Najib, the DPM should now come out and state irrevocably that Razak Baginda was not at all involved in the murder of the mongolian model.Yes, then it would be a classic case of you scratch my back and I scratch yours.Razak must be naive to think that people is going to believe his self confessed version of events when so many unresolve issues remained unresolved.

Hello, what happened to the Statutory Declaration of private Investigator, Balasubramanian, who in his first S.D made an unequivocal statement that Najib was acquainted with the murdered model and that their relationship was more than plutonic. Not only was it more than plutonic, their sexual tryst was luridly described in detail. And just as quickly as the first S.D appeared a second S.D was hastily authored by the private investigator to dismiss the first S.D on the grounds that it was made under duress. It was never made clear where that duress originated from. And after having made the second S.D to deny the authencity of the first S.D he made a disappearing act worthy of David Copperfield .And till today, the David copperfield protege has simply vanished without trace and the police acting with indifference over the two contradictory S.D's which would have thrown the Altantuya case wide open.

And what about blogger Raja Petra Kamarrudin's Statutory Declaration linking the wife of Najib to be present at the murder scene ?These three S.Ds should have been compelling evidence to implicate the personalities mentioned in the S.Ds and yet for some mysterious reasons were never exhaustively investigated by the police and pursued by the public prosecutor.

And the most shocking turn of events was the acquittal of Razak Baginda , the central figure in the murder case , without his defence being called. The acquittal has made the case virtually 'floating' with two protagonists involved in a murder without any motives or connection whatsoever .And quite expectantly, the prosecutor did not even attempt to appeal the decision of the acquittal with the lame excuse that the Judge made a finding of fact that according to them was indisputable.

Without further investigation of the role of the DPM and the subsequent acquittal of Razak Baginda in the Altantuya murder case, the whole case crumble for want of a motive by the two body guards of the DPM who had no rhyme or reason to execute the murder of the Mongolian beauty.

An even in the unlikely event that both the body guards were to be convicted for the murder of the mongolian woman, there is every likelihood that both will not serve any prison term.Has any one ever wondered why the identity of the two police personal has been zealously guarded to the extent that there is no media publication of photos of the two men?And is it not possible that even after conviction the two men could be surreptiously released without the knowledge of any one other than those who had planned to protect the identity of the two men?

The Altantuya murder case becomes even more perplexing when two men who are strangers to the murder victim are being charged with a violent crime that was designed to totally obliterate any evidence and trace of the Mongolian woman. And why would any one attempt to eradicate immigration records of the mongolian entry into the country? All these purported act to manipulate evidence lend further credence that unseen hands and unseen actors play a crucial role in the murder of the mongolian beauty.

It is a farcical attempt for the court to try and convict two men who at best would be scapegoats for the real perpetrators.

P.M's "Anyone can Be P.M' is an outright lie.

Our Prime Minister Abdullah Ahmad Badawi never ceases to amaze me. Even in the last leg of his tenure, he is still telling lies which any one listening to would know is an outright lie.
His recent statement that ‘anyone can be prime minister' in Malaysia really tops the mother of all his lies.

How could anyone from a minority race - either an Indian, Chinese, Iban or Kadazan etc, - be accepted as a PM when the simple appointment of a Chinese woman to be the acting general manager of PKNS could create such a ruckus?

Where was our PM when the hue and cry over that appointment took place? Not even a whimper from him and yet he has the gall to tell his audience that 'anyone can be PM’.

What about in Perak after the recent general election when DAP won the majority of the state seats?
Instead of a Chinese assembly person from the major winning party being given the Menteri Besar’s post (which by convention should have gone to the party winning the most seats) it was instead given to Malay assembly person whose party only won a few seats.

Malaysia has a long way to go before it can emulate what Barack Obama has achieved in America.

Umno and our present Malay leaders are too deeply entrenched in their Ketuanan Melayu policy that it is unlikely they will ever discard this race-based ideology that has served them so well for the last 50 years.

Even the mere mention of the weaknesses of this policy has brought the wrath of the Umno leadership on the erstwhile former law minister Zaid Ibrahim.
What more if there is any concerted attempt to abandon this policy in favour of one that does not discriminate against race, colour , creed or religion?

Americans have the shown to the world that they have moved beyond politics based on race and that even a miniority race member can become the president of the world's most powerful nation .

Unfortunately, in Malaysia we are still mired in racial and religious bigotry. Instead of uniting the various races with a multi-racial policy, they have instead embraced a divide-and-rule policy.
This is a policy which emphasises the bumiputera and non-bumiputera dichotomy. And after 50 years of BN rule, our nation has never been more vulnerable.

Why a Chinese Cannot Be a G.M of PKNS?

A weak leader always compromise. A decision made can be retracted the moment there is any opposition. That simply defines the personalityof Menteri Besar of Selangor, Tan Sri Khalid.

His initial decision to appoint the Deputy general manager, Low as the General Manager was made for the simple reason that she was the most capable and suitable candidate for the post.It would have been history for PKNS to appoint a chinese to a post which had always been the domain of the malay bumiputra.Tan Sri Khalid would have won admiration and acholades if he had persisted with his initial desire to appoint the best. But later when he succumbed to PAS and UMNO's opposition and meekly conceded that it was only a temporary appointment, it became apparent that he was not made of sterner stuff. He exemplified his character as one who has no leadership qualities to lead and that he would wilt the moment there was some pressure or opposition.

The protest by the six staff bodies was uncharacteristic of employees dictating to employers who should manage them.No public body or firm would tolerate such nonsense and why should PKNS be an exception? If any of the staff had refused to work with the appointed G.M then they should resign and if they persist in their attitude then they should be sacked. PKNS assets and capital belongs to the State govt and not exclusive to any one race. The stated objectives of PKNS is not to enrich or help only one race. PKNS belongs to all Selangor state citizens and it is their rightful duty to assume that a proper and qualified person be appointed to manage the body.PKNS was never meant to be a vehicle to fill the quota of Bumiputras. For 51 years UMNO has inculculated that mentality with the malay race that now they are demanding for their own selfish purpose to continue with that unsavoury practice of appointing a malay G.M irrespective of his capabilities.

If PKR for all its exhortations of abandoning race-based policies cannot even appoint someone based on merit rather than based on race, then one can safely say that PKR days are numbered. We placed so much faith on PKR to move away from UMNO's race based policies and in the end it appears we have never departed at all from that old mentality which UMNO has consistently practiced.

Scrap Housing Quotas Based on Race.

Prior to the 8th March election, Pakatan made a promise in their manifesto that housing quotas would be based on need and poverty and not on race. Annuar himself on many of his ceramahs made that solemn promise. Now six months down the road, none of the five states that Pakatan took control has even started to dismantle that old bumi quota based on race.

What seems even more contradictory was the PAS govt in Kedah implementing a policy that require a 50% compliance of units to be sold to Bumis.Apparently, PAS did not subscribe to Pakatan's manifesto that Housing policy should be based on need and not on race.Instead it would seem that PAS was of the view that B.N's previous policy of 30% bumi quota was inadequate, thus the introduction of the 50% policy.

Looking at PAS history of administration in its state of Kelantan and Trengganu one thing becomes obvious. They just simply lack the experience of governing a state. Many a time they have shot themselves in the foot simply because they implemented populist policy which in reality did not work.

Introducing a 50% bumi policy in the housing sector simply means that rich bumis can buy houses at a 10% discount while poor chinese and indians have to bear the full cost. This translate to a very ridiculous situation where the poor non-malays has to subsidise the rich bumis. Not only is such a policy discriminatory but racist to the core. The criteria for qualification is race and not need or poverty.

Pakatan Rakyat made a promise that its policy would be based on poverty and need and that was the reason why it made a promise to abolish the NEP and replace it with a policy that was equitable to every one irrespective of race. That promise has not been kept in any of the PR governed states.

Tribunal Must Be Set Up To Try Past Politicians

When the final curtain closes on the B.N govt which had governed this nation for 51 years, a tribunal should be set up to try those politicians who have manipulated our country's Judiciary, the Police, the Attorney- General office and all the tainted public instituitions which had become beholden to their political masters.Included in this category should be those who had used and abused their position in office in furtherance of their political ambitions.

Begining with the last Prime Minister,Mahathir, his legacy was fraught with monumental corruption .During his 22 years tenure he had used govt resources to bail out his son's ailing shipping company, gave lucrative contracts to his children and cronies and in the process enriched himself with wealth that far exceeded his remuneration as the Prime Minister of this country.

Next would be the incumbent Prime Minister who had also used his position to secure contracts and services for his son's business and also for his son-in-law, Khairy. He should then be investigated for the abuse of his powers in using the ISA to incarcerate civilians and politicians who had not threatened national security but were mere ordinary citizens and politicians who had expressed contradictory views of govt policies.

All ministers from the B.N who had amassed huge fortunes beyond what they should have earned and in this category, Ling Liong Sik, Samy Vellu , Daim Zainuddin, Najib ,former Negri Sembilan M.B Mat Isa , former Selangor M.B Muhammad Taib, Sarawak Chief Minister Abdul Taib Mahmud, and the Sabah Chief Minister Musa Aman .In addition the rogue gallery of politicians who had plundered the nation's coffers should further include all Ministers and M.Bs whose wealth were obtained under dubious circumstances.

The ACA should also be empowered to investigate thorughly the background of all those personalities mentioned above and from the basis of their report they should be charged in a court of law for corruption and other abuses perpetuated during the course of their tenure.

In order for our nation to move forward we must spare no effort to ensure that future leaders will not succumb to the same temptation that beseech our past leaders and which sadly have caused our nation to descend the slippery slope of self destruction.

To Silent RPK at Kamunting

Outside the prison wall in Kamunting for which Raja Petra is incarcerated, the guilty ones are free to roam. When he was outside he caused havoc and sleepless nights for those who had reason to conceal their murderous act.RPK's revealation that Najib's wife, Rosmah was present when the Mongolian model was blown up resulted in a criminal defamation suit brought by the Attorney-General.RPK then went further to reveal the Statutory Declaration by the Doctor who had examined Saiful and concluded that he was not sodomised. RPK's exposition of these two critical events not only struck some raw nerves but also sent the guilty party scurrying for plans to put RPK away in Kamunting.

If indeed RPK had made a false Statutory Declaration then existing laws should be adequate to charge and punish him.Why was he not charged if he had indeed made a fictitious S.D?Surely there are penalties for making false Declarations .And if they are false the contents can be investigated . Was this done and why was no report publish to accept or deny the status of the S.D?

Conveniently, RPK was charged under ISA for insulting the Islam religion in his articles. I have read all his articles and I cannot deem any of his articles coming close to insulting the Islam religion. And indeed if he was accused of doing that then he deserves an opportunity to defend himself. Why was he not given that opportunity?

Home Minister , Syed Hamid Albar will have to one day answer for his act of signing the papers that sent RPK to Kamunting. On whose behest did he act by sending RPK under S8 of the ISA Act for a two year period detention and which can be renewed indefintely.Since he was detained under this section it had clearly preempted the Habeas Corpus which his counsel was to file and which had rendered the whole process purely academic.

In short, justice was abrogated and silence because sending RPK to Kamunting would totally deprived him of any opportunity to defend, to expose and to punish those guilty parties with the information that he was supposedly privy to.Now that he is incarcerated in Kamunting, the hearing of the criminal defamation suit will be arrogated to some obscure date when the public at large through the passage of time would have totally forgotten about the man and his mission.

The Home Minister definitely acted with malice in sending RPK to Kamunting.Existing laws would have been sufficient to charge RPK. Why was it not used ? Why the haste in sending him under ISA when it was so close to the date in October when he had to defend his criminal defamation suit and where he had promised he would reveal in court how he was privy to the information that the DPM's wife Rosmah was at the scene of the brutal crime where a young Mongolian woman was blown to smittens

.RPK's incarceration in Kamunting would totally anihilate and close the chapter of all his previous disclosure of how events transpired on that fateful night.

One country, two Laws.

It was only last week when P.M made a call to the media to tell the truth. So what happened to the Sin Chew reporter who reported what was said by the UMNO politician, Ismail Ahmad? She was first hauled in by the police to explain why she had reported the utterances that the 'chinese were squatters'.Not satisfied with that, on the 12th of Sept. she was arrested under S. 73 of the Internal Security Act (ISA) and whisked to an undisclosed destination .All these arrogant act by the police despite the confirmation by two other journalists confirming the authencity of the statement reported.

What perhaps even boggles the mind was the presence of DPM , Najib ,who attended the function and who made a reluctant attempt to defuse the situation a few days later ( when the situation escalated into a slinging match between leaders of the B.N component parties) by making an apology.Surely if Najib did not hear those racist statements being made would he have made that apology? To question the reporter over the statement is tantamount to undermining the integrity of Najib because it would make the latter complicity to suppress the truth.

What makes the arrest of the Sin Chew Daily journalist even more perplexing was her subsequent released after 16 hours of incarceration. The Home Minister,Syed Hamid Albar statement was totally incomprehensible. It was according to him 'for her own protection'.How could any one be offered protective custody when in the dark of the night that person was taken away without offering the option whether one was prepared to be whisked away to an undisclosed destination without even offering an explanation to the family? No, the true reason was that they did not expect the response from the civil society and the activist who were totally shocked at such a brutal suppression of news as reported by the mainstream media. And it was this unexpected backlash of public dissent that won the freedom of the Sin Chew daily journalist.

The lesson to be learned from this unsavoury episode which has earned us international scorn and notoriety is that there appears to be two sets of law in this country. One law applicable to UMNO members and politicians who are meted punishment for infringing the provisions of the UMNO constitution. This category of offenders need not fear the long arm of the Malaysian Law.Once UMNO disciplining Supreme Council dish out the punishment to the UMNO offender the matter is no longer taken up by the Malaysian Law. Such was the case of the UMNO politician who was given a three years suspension from his party while the Journalist who did her job by reporting the racist utterances was unceremoniously hauled away under the ISA.

Ong Ka Ting Last Chance For greatness.

MCA's leaders should by now be aware of the political significance of the 8th march , 2008 election which swept the oppositon to power in five states. If there is still any doubts, the Permatang Pauh by-election which gave Pakatan Rakyat, Annuar Ibrahim a landslide victory should cast aside any reservation why the non malays have abandoned traditional race based party and gave their full support to the opposition parties of DAP and PKR.

From their current jockeying for MCA leadership one important aspect which most of them fail to take stock is the future direction of the party.None of the leaders seem to have any idea where the future direction of the party was heading. If the current groundswell of discontentment among the non-malays is any indication MCA would be history after the 13th General Election. Therefore it becomes irrelevant and of no consequence who shall lead MCA if their intent was to remain in the Barisan National.

MCA and all the other B.N component parties in the coalition will die a natural death after the next general election. That was further confirm by the Cross street polling station in Permatang Pauh where majority of the chinese voted for Annuar. And all these despite the promise of monetary contribution to the chinese schools. In previous elections such a strategy would bought support from the chinese community. But after 50 years the non-malay voters have become more savvy with their electoral preference.

Ong Ka Ting , the current President of MCA would do a great service to the chinese community if he should choose to make a momentous and history changing decision to take MCA out from the Barisan National and join the current popular Pakatan Rakyat.Ong's decision to change the future direction of MCA by joining Pakatan Rakyat would not only save an otherwise doom party but would rekindle its aspiration to represent the interest of the chinese community.Failure to do this would spell the death Knell of MCA as a party representing the chinese.

An astute leader would have seen the writing on the wall. The chinese would no longer want to play second fiddle to UMNO and be merely satisfied with the crumbs that they dish out to the MCA leaders .For too long, MCA leaders have remain silent while UMNO's racists members lashed out and threaten chinese leaders who vocalised a more equitable policy in education and business policies. In Anwar, they now have found a leader who would be fair and equitable to all races guided by the basic principle that need and poverty would supplant the policy of helping along racial lines.

The policy espoused by Pakatan Rakyat is a fair and equitable one.If 70% of the poor living in rural areas are malays then so be it, they would qualify for the bulk of the govt's help. The policy implemented would be to help 70% of the poor malays not along racial lines but because it so happen that 70% of the poor are malays. However, 30% poor indians and chinese are also not forgotten. The policy would automatically extend help to other communities who needs help because of their poverty levels and not because of racial factors.Such an equitable policy even though slanted to help the rural malays more would be acceptable to all races because govt assisstance is only extended to those who genuinely needs help and not to those who are rich and belong to one particular race.

Ong Ka Ting would go down in history as a great chinese leader if he can grasp this opportunity and lead MCA into a new and acceptable direction that would guarantee a brighter future for the chinese community. If Ong choose not to do so then he will go down in history as the President who could have changed the plight of the chinese people but choose not to do so.

Door To Putrajaya now open

The march 8th 2008 General Election was a defining moment which saw the Barisan National lost its 2/3 majority and the lost of five states to Pakatan Rakyat. That monumental defeat should have been the warning sign that there was immense dissatisfaction among the rakyat.Instead of focusing their energy redressing what had caused their abysmal defeat they conjured a plan to charge Anwar Ibrahim on a dubious sodomy charge.

However , whatever plans they still harbour to frame a sodomy charge on Anwar and deprive him of the Prime Ministership was totally banished when Anwar won the Permatang Pauh parliamentary seat.It was fairly plain that with that victory the road to Putrajaya was now opened for Anwar.

What appears a simple march to Putrajaya may however be still paved with obstacles. The September 10th date at the court where Anwar will face the sodomy charge has a sinster motive. The swearing on the Koran by Saiful on the eve of nomination was for a political purpose. It was intended to cast aspersion on Anwar as a sodomist and to influence voters sentiment in favour of the Barisan National candidate. Now that this had failed and Anwar had won with a bigger majority than his wife, the ultimate plan now was to throw him to the court so that it would be the final nail in the coffin for the Pakatan Rakyat leader. It was no coincidence that the 10th sept date was to throw a spanner in the works of Anwar's 16th sept date of dethroning the Barisan National Govt.

The powers to be at Putrajaya will not allow Anwar to stroll to the capital without any semblance of resistance. The loser may well be answerable to a host of mismanagement and corruption issues .And for the victor, a chance to reform all the institutions that have been tainted when it was under Mahathir's 22 years legacy. That would have been good enough reason for both sides not to lose. But for Anwar, the road to Putrajaya will remain open and the rakyat do not expect him to falter.

P.M finally show he is a leader for the Malays only.

I refer to the Malaysiakini article 'P.M vetos call to open UITM to non-malays'.
When Abdullah Badawi assumed the mantle of Prime Minister he vowed he would be a leader for all Malaysians. However his statement on 13th August, 2008 where he vetoed Pakatan Rakyat Selangor Menteri Besar's call for UITM to be opened to non-bumiputra clearly showed that what he espoused was not what he had meant. His veto of Tan Sri Abdul Khalid proposal of admitting non- malays in this tertiary institution is clear proof that the P.M is a leader of only one race.
No leader of a country that is diverse and multi-ethnic can ever perpetuate a policy that favours one race and yet claim magnanimously that he is a leader for all.
The myopic policy of enrolling one exclusive race in an institution of Higher learning will result in a generation of malays growing up without any contact with another race. Such a policy will have adverse implication on future race relations where religion has already created a wide chasm between the three major ethnic populace.
Tan Sri Abdul Khalid proposal for an initial 10% entry of non-malay is a legitimate plea to open up UITM so that some form of competition could be given to the otherwise exclusive malay students. This in turn would also allow some form of integration among the races and augurs well for a multi racial identity.
It is rather unfortunate that the University' Vice Chancellor Prof Datuk Seri Ibrahim Abu Shah should even oppose such a plan when you would expect an academic to be supportive of attaining academic excellent by opening its institution based on merit. It is ironical that an academic who choose mediocrity in its enrolment policy should be even appointed to be the Vice Chancellor of an institution that profess to be churning out students who 'now hold top positions in both the public and private sector

A Govt doomed to Fall

This government has failed us. Those who voted to allow BN to continue ruling the country must now be kicking themselves.
For the first time in 50 years of BN rule, the people have a glimpse of how pathetic our leaders are. They would resort to any evil deeds so as to frustrate any one brave enough to challenge their authority.
That someone who dared to challenge BN was Anwar Ibrahim. And for that he is now paying the price for his ambition of becoming the next PM. This government has shown that it will not only not tolerate dissent but it will not sit by and allow any one to usurp what they feel is their divine right to govern this country for eternity.
The sodomy case against the Pakatan leader has made a mockery of our country. Our home minister has made a fool of himself by ordering a convoy of 15 police cars to arrest a defenceless old man of 60.
By emphasising the importance of sodomy as a crime of major proportions the home minister has made us a laughing stock of the international community.
Instead of focussing its attention and resources on the murder of the Mongolian model where altogether three statutory declarations have been made mentioning the DPM, the police chose to harass and arrest a man on a dubious sodomy charge.
For the second time in 10 years , the police have portrayed themselves as a tool of the ruling party when they should have been bipartisan.
Their active participation in an insignificant crime for political expediency when serious crimes are skyrocketing only reflects their lack of professionalism.

Najib must be a P.m without a stain.

Before UMNO underlings like the UMNO Putera chairman start to challenge Pakatan de facto leader to swear on the Quran in order to prove his guilt or innocence, I suggest the chairperson should first prioriotise the gravity of the offence.
In most civilised and developed countries homosexual activities between consenting adults is accepted and does not constitute a criminal offence. What two consenting adults do within the confines of their bedroom is nobody's business but their own
The govt by attempting to charge one of them for sodomy just because one of the consenting adults choose to bare his sordid details is making a mockery of our institutions like the Police dept, the Attorney-General Dept and principally the whole Govt institution which indirectly played a vital role in bringing the case to light.
What perhaps the UMNO Putera chairman should demand is for the Deputy Prime Minister, Dato Najib who is slotted to become the next Prime Minister to swear on the Holy Koran that he and his wife is totally absolved of any involvement in the Altantuya murder.
The Statutory Declaration made by Razak Baginda's private investigator gives further credence that the DPM was in some way involved in the dastardly act of murder.
Whereas homosexual activities between two consenting adults does not constitute an offence in most civilised countries, this cannot be said of murder or accessory to murder. The crime of murder in every country whether civilised or uncivilised is a capital offence. It is a universal crime which cannot be exempted from punishment.
Therefore it must be baffling to ordinary citizens why the Police dept and the Attorney-General is placing so much emphasis on the sodomy charge while treating the Altantuya murder nonchalantly. And this despite two statutory Declarations being made to implicate the DPM and his wife of involvement of the murder?
The Deputy Prime Minister is groomed to be the next Prime Minister of our country. Can he assume the mantle of the Prime Ministership in the near future with a stain and blemish of his involvement in a murder case? What would be the implication to the country if after his ascendancy there was irrefutable evidence to indicate his involvement?
All this implication of the DPM's involvement can only be banished once and for all if the Police seriously carry out an unbiased investigation without fear or favour and to eventually provide irrefutable evidence as to his guilt or innocence.
The first Statutory Declaration made by blogger, Raja Petra was most damaging and pointed directly to DPM and his wife involvement and despite a month after the Statutory Declaration there is no evidence or attempt to refute the revelation made. The DPM's wife even was generous to a fault by declaring she would not sue the blogger for defamation. The feeble attempt by the DPM to dismiss all those allegations as merely political attacks is unacceptable. The ordinary citizens deserves to know the truth and nothing but the truth.Mere denials cannot form the basis of any defence and therefore exonerate his guilt.
Unless and until there is conclusive proof that he was in no way involved in Altantuya's murder there is no likelihood Malaysians will accept him as our next Prime Minister.

Sodomy episode smells of entrapment.

Why are the police so worked up over an insignificant report by a young man that he has been sodomised?
Every neighbourhood is swarmed with reports of murder, rapes, snatch thieves, ATM robbers, goldsmith robbers and a host of other crimes that seem to increase by the day and yet, for some unfathomable reason only known to the police and the Attorney-General’s Chambers, they pay so much undue attention to the case of a young man who suddenly unabashedly tells the whole world that he has been sodomised.
The flurry of activity at the 'crime site' with a forensic team coming in and out depicts a crime of major proportions.
If only they had shown similar diligence in tackling the neighbourhood crimes they would have won more accolades.
As for the allegation, unless there is a consensual thing among both parties for the act to be consummated, I can’t for one precious moment think how a man of sixty and a young man of twenty three could ever put the act together if there is even the slightest resistance from the complainant.
And if this was really a consensual thing between two consenting adults, each with every intent to enjoy the forbidden fruit, then why for god’s sake would he suddenly turn around and point an accussing finger at the very person who had penetrated him?
Even if it was true, what two consenting adults do within the confines of their castle is no business of anybody unless of course one party decide to kiss and tell.
And why would any one who indulge in such a past time want to tell the world of his dysfuntion?
The whole unsavory episode smacks of entrapment and conspiracy with every intent to deprive this nation a man worthy to be our next national leader.
Malaysians of every ethnic divide will not accept the simplistic version that the government had no hand in snarling the prey to the lion's den to be slaughtered at the altar.
No matter how the government’s judiciary may arrive at their verdict, Malaysians will not want to be fooled a second time round.

Stop selling subsidised Petrol and Diesel to Foreigners.

When leaders are under siege and the political scenario they operate are in a state of turmoil, there is a tendency for them to make the wrong decision. The decision to increase the price of petrol and diesel signifies such a case.
The flawed decision of granting the subsidy scheme for petrol and diesel in the beginning was a bad decision. The decision to increase the price now was made too late and long overdue.Basic economic principles dictate that market forces should be allowed to determine supply and demand.and hence price will prevail at the point where demand equals supply.Any attempt to manipulate price by means of subsidy will create an artificial demand and supply situation.
Subsidy will inevitably create a black market situation and encourage smuggling of the goods for pecunary gains. In this case subsidy depresses the price of the goods vis-a-vis the market price and unscrupulous people will capitalise the situation by selling the subsidised goods to neighbouring countries where it is sold at market price.
Such a scenario is displayed along the coastal boundaries of kelantan, Kedah, Selangor and Malacca where fishermen under their legitimate guise of fishing, transfer their load of subsidised diesel to waiting foreign vessels for a quick monetary profit. Two thousand litres of diesel at a paltry profit of 50cts per litre is sufficient to net $1000 for a day's work.No wonder empty vessels returning home without any fruitful catch is a common occurrence.
Common sense dictate that if the fishermen need subsidy to continue with their profession then its about time they should abandon fishing and seek new pasture in other ventures that are more lucrative. If Thailand and Indonesian fishermen can fish and sustain their venture profitably without any subsidy then why cant our fishermen do the same?Giving them subsidy for them to continue in a not profitable venture is not a viable option in the long run.It would be better for the govt to encourage them to venture into something else without the dependency of a subsidy.

In the case for increasing the price of petrol and diesel, the govt at first made the right decision to ban the sale to foreign vehicles on a 50km radius of the border towns. This option was sensible and most practical since it immediately cease to subsidise the sale of petrol and diesel to foreigners who were capitalising from the difference in the pump price of the neighbouring country. In Thailand the pump price of petrol is $4.00 per litre and at the border town of Rantau Panjang the pump price is $2.70 per litre. With the unending daily queue of foreign cars lining up to fill their cars a modest estimate of one million litres of subsidised diesel sold could translate to $1.3 million loss of daily revenue. In a year the govt will be subsidising an astronomical amount of $468 million and that is just on the border town of one place. How much is lost in total from all other border towns is any body guess.
The question that begs to be answered is why are we selling subsidised petrol and diesel to foreigners? The fact that subsidised petrol and diesel are not reaching the targeted group should be good reason enough to stop the sale of petrol and diesel to foreigners at border towns. Why the flip flop decision to lift the ban of sale to foreigners?
The lack of a proper policy to address this serious leakage of our country's finance is a mismanagement of our country's resources.Previously when the pump price was subsidised at $1.92 per litre our country must have lost billions. Can the policy makers please tell us why we are not addressing this serious financial leakage?

45% of PSD scholarship go to non-bumis.

I wish to refer to your article dated 29th may regarding the disbursement of PSD scholarships to Bumis and non-bumis.
The public service department pointed out that "there is a fairer distribution of Public service department scholarships for all races for degree studies abroad from this year, with 1100 going to bumiputras and 900 to non-bumiputras". In spite of this the PSD received 3000 appeals from post SPM students who failed to get scholarships for studies abroad.
Perhaps what the public would like to know is on what basis are the students being selected? The 45% for non-bumis and 55% for bumis seem to imply that selection is solely based on a racial quota and not based on meritocracy.
If the selection is based on merits then it is incumbent upon PSD to be transparent and reveal the methodology in which the students for the bumis are selected. The scholastic achievements of all the successful 1100 bumi and 900 non-bumi students should be published in order to dispel any doubts that the bumis are selected based on race rather than on merit.
But the statement by PSD Director-General Tan Sri Ismail Adam that those rejected (3000 students) received low marks for interview and below active curricular records raised more suspicions than adequate justification. His statement seems to imply that the 1100 bumis who were successful received high marks for interview and also high curricular records and on top of that all had 9As and above in order to qualify for the benchmark.
It is rather hard to believe that all the 3000 rejected students had low marks for interviews and low marks for curricular activities whereas the successful 1100 bumis students all had high marks for interview and curricular activities.
Perhaps the PSD should be honest and let the public know whether the selection criteria is solely based on racial quotas for the bumis and for the non bumis the selection is based on merit.

If it is true that the selection by the PSD for the bumis are based on a racial quotas then it certainly explain why many of the unemployed graduates are bumis..It should be apparent by now that simply churning out unemployable below par graduates is not the answer to our human resources problem
